These General Terms and legal information (the "General Terms") govern the use of and access to the website www.momoven.es, owned by MOVEMO IBERICA, S. L. ("Momoven"), through which the web platform is made available to users (the "Platform").
Acceptance of these General Terms creates a binding contractual relationship between you (the "User" or "Users") and Momoven.
In compliance with Article 10 of Spanish Law 34/2002 of 11 July on Information Society Services and Electronic Commerce, the identifying details of the owner of the Platform are:

Momoven is a collaborative consumption platform that enables motorcycle rental between private individuals. Through Momoven, Users can easily and safely rent motorcycles from other Users of the Platform who are nearby.
If you own a motorcycle (an "Owner"), you may offer it so that other Users (the "Drivers") can rent it during the periods when you do not use it.
As a Driver, Momoven enables you to find motorcycle rental offers from private individuals near your place of residence or in the area you choose.
The Platform may also offer motorcycles from vehicle rental companies with which Momoven has previously signed collaboration agreements.
Momoven acts as an intermediary and provides the Platform so Owners can offer motorcycles for rent and Drivers can rent them. Momoven does not intervene in disputes between Users, including disputes between Owners and Drivers.
Users must not use the Platform or its content for unlawful purposes, to harm third-party rights or interests, or in any way that may damage, disable or impair the Platform, its content or services. Momoven may remove any image, comment or User that it considers contrary to the company's principles, without prior notice.
Momoven does not guarantee the operation of the Internet network. The service may be unavailable or limited at any time for reasons beyond Momoven's control, including emergencies, overloaded connections, link failures, network equipment issues, transfers or signal strength. Momoven is not liable for data, messages or pages lost or not saved due to Internet service performance issues.
The User acknowledges and accepts that use of the services offered through the Momoven Platform takes place under the User's sole responsibility. The User shall be liable for any damages Momoven may suffer as a result of breach of these General Terms or applicable law in connection with the use of Momoven's services.
To register on the Platform and enter into a contractual relationship, the User must be at least twenty-three (23) years old and hold a valid Spanish, European or international driving licence, in force and without suspension or limitation. The User must provide the requested personal, contact, driving licence, profile and bank account details through the applicable form.
Users may add any profile information they consider appropriate. Owners must provide a detailed description of the motorcycle, including as much information as possible about the vehicle.
The User guarantees that the personal data provided is true and accurate and undertakes to notify any change or modification. Momoven may request official information to verify the accuracy of the data supplied by Users.
Motorcycles may be offered and rented as often as desired, although the maximum rental period is ninety (90) consecutive days.
Registration requirements, responsibilities and prohibitions for Drivers
In addition to the general requirements applicable to all Platform Users, Drivers must be over 23 years old, hold a valid driving licence accepted in Spain, be a Spanish individual and/or resident in Spain with DNI and/or NIE, or provide a passport and valid driving licence from their country of origin through the registration process.
Drivers must authorise rental charges, pay the deposit requested during the booking process, pay any amounts due under the insurance policy when liable, and pay for damage caused to the motorcycle up to the maximum liability limits set out in these Terms.
Drivers are responsible for motorcycles during the rental period, including sanctions, fines, infringements, expenses or damage arising from use of the vehicle. They must respect traffic rules, follow the Owner's recommendations, promptly report incidents, return the vehicle with the same fuel level and correctly complete the rental agreement with the Owner.
Drivers must not use the Platform for fraudulent activities, move rentals outside the Platform, drive under the influence of alcohol or drugs, use the motorcycle for illegal purposes, misappropriate or sublet the vehicle, rent it for another person, tamper with the motorcycle, create multiple profiles to avoid negative reviews, introduce harmful systems or damage Momoven's reputation or that of third parties.
Insurance, damage, tyres, management fees and rental process
Rentals formalised through Momoven must comply with the insurance conditions applicable to each motorcycle and booking. The scope, exclusions, excesses, deposits, guarantees and any additional protection plans shall be those shown during the booking process and in the applicable policy or contractual documents.
The Driver may be liable for external damage, tyres, accessories, fines, cleaning, fuel differences, late returns, towing, administrative procedures and any other cost attributable to the Driver under these Terms, the booking conditions and the evidence recorded in the rental agreement.
Together with the booking, the Driver must pay an additional amount for mandatory civil liability insurance and driver personal accident cover. If the Driver does not wish to pay the costs arising from this insurance, the Driver may not carry out any motorcycle rental operation through the Platform.
Momoven offers the following insurance plans, which must be selected by the Driver when requesting the rental through the Platform:
- Basic Plan: basic third-party insurance, mandatory civil liability, voluntary civil liability, legal defence, damage claims and driver accidents.
- Standard Plan and Premium Plan: basic third-party insurance, mandatory civil liability, voluntary civil liability, legal defence, damage claims and driver accidents.
This insurance does not include cover for damage to the motorcycle itself caused by impacts to the external elements of the vehicle, glass breakage, theft, fire or natural phenomena during the rental period. The mandatory insurance terms can be checked by clicking here. Both Owner and Driver know the requirements for correct policy coverage, which are detailed throughout this document, and declare that they have read and accept the terms included in the policy.
The Driver shall be responsible for damage suffered by the vehicle during the rental, provided that such damage is recorded in the vehicle return form, up to the following maximum damage liability amounts, which vary depending on the selected civil liability insurance plan.
- Basic Plan: the Driver is responsible for any damage, robbery, theft or fire affecting the motorcycle during the rental.
- Standard Plan: maximum liability for robbery, theft and damage of EUR 4,000 for Naked, Sport and Custom motorcycles of 951cc or more and all Off-road motorcycles; EUR 3,000 for Naked, Sport, Touring, Supermotard and Custom motorcycles from 500cc to 950cc and Trail motorcycles of 950cc or more; EUR 2,000 for Naked, Sport, Touring, Supermotard and Custom motorcycles from 250cc to 499cc and Trail motorcycles from 250cc to 949cc; and EUR 1,200 for Naked, Sport, Touring, Supermotard, Custom and Trail motorcycles up to 249cc and scooters.
- Premium Plan: maximum liability for robbery, theft and damage of EUR 2,000 for Naked, Sport and Custom motorcycles of 951cc or more and all Off-road motorcycles; EUR 1,500 for Naked, Sport, Supermotard and Custom motorcycles from 500cc to 950cc, and Touring and Trail motorcycles of 950cc or more; EUR 1,000 for Naked, Sport, Supermotard and Custom motorcycles from 250cc to 499cc, and Touring and Trail motorcycles from 250cc to 949cc; and EUR 600 for Naked, Sport, Touring, Supermotard, Custom and Trail motorcycles up to 249cc and scooters.
The above limits shall not apply in cases of misuse, prohibited use, negligence or fault, for which the Driver shall be fully liable, including in particular: driving under the influence of alcohol, drugs or narcotics; driving without the required permit or licence or without the Owner's authorisation; commission of the offence of failure to render assistance, but only regarding the consequences of the traffic accident for the authors, accomplices or accessories; participation in races, competitions or training sessions; and driving inside airport premises or on unpaved roads.
Robbery/theft cover only applies within Spanish territory. If the robbery or theft occurs outside Spain, the Driver shall be responsible for the full value of the vehicle.
Upon formalising the booking, the Driver must provide a valid credit card and pre-authorises Momoven to charge the repair cost for damage to the motorcycle during the rental period, up to the limits set out in this section as maximum damage liability and robbery liability. Momoven may assume, where applicable, the excess repair cost for external damage caused to the vehicle if it exceeds the maximum damage liability limit, except in the exclusion cases expressly provided above, in which Momoven reserves the right to recover all costs assumed due to damage caused by the Driver through misuse, fault or negligence.
Charge authorisation:
A. EUR 1,000 for Naked, Sport and Custom motorcycles of 951cc or more and all Off-road motorcycles.
B. EUR 600 for Naked, Sport, Touring, Supermotard and Custom motorcycles from 500cc to 950cc, and Touring and Trail motorcycles of 950cc or more.
C. EUR 600 for Naked, Sport, Supermotard and Custom motorcycles from 250cc to 499cc, and Touring and Trail motorcycles from 250cc to 949cc.
D. EUR 300 for Naked, Sport, Touring, Supermotard, Custom and Trail motorcycles up to 249cc and scooters.
This charge authorisation does not limit liability to those amounts. The Driver shall be responsible for the total repair or compensation amount, even when it exceeds the amount authorised to be charged.
Tyre cover plan
Tyre cover applies to full or partial damage caused externally to the insured tyre that affects its correct functionality and results from a repairable puncture or a non-repairable blowout.
The following are expressly excluded: tyres not suitable for road use, including tyres whose wear at the date of damage does not comply with the manufacturer's standards; tyres whose wear exceeds the standards of the General Vehicle Regulations, currently set at 1.6 mm; retreaded or recut tyres; damage caused by an accident or event prior to contracting; damage caused by hydrocarbons; damage resulting from incorrect fitting or improper or abusive use; slow air leaks not caused by accidental damage; consequential damage from sporting activities such as races or use on roads or paths unsuitable for circulation; hidden defects or manufacturing defects; cases in which the insured damaged tyre is not presented; damage caused when the tyre was used after the initial damage; damage to tyres as a consequence of an accident involving the vehicle; parts other than covered tyres, especially rims, valves and bolts; any damage to the vehicle carrying the tyres or its accessories, as well as noise, vibration, wear, grip problems and driving performance issues; towing and repair costs affecting the vehicle carrying the tyres; fitting costs for the spare wheel; tyre maintenance and inspection costs; costs incurred without Momoven's prior consent; robbery or attempted robbery of the insured tyre or vehicle; financial losses or damages suffered during or as a result of tyre damage; and negligence or fraudulent conduct by the insured or beneficiary.
Restrictions: cover is limited to a maximum of one (1) tyre as a result of the same claim and to one (1) claim, after which the contract shall be terminated. The guarantee extends only to claims occurring within the European Union.
The policyholder must pay the premium and applicable surcharges and taxes; disclose all known circumstances that may affect identification and assessment of the risk; notify claims within no more than 24 hours after they occur; strictly follow the claim procedure described in the contract; use the vehicle reasonably according to its characteristics; and, in the event of breakdown, avoid worsening it through improper or negligent use. Breach of this obligation shall result in loss of the right to compensation. The insured vehicle and tyres must be submitted to inspection by experts appointed by Momoven, unless there is justified cause, where necessary to complete the reports provided by the policyholder, Owner or repair shop.
Guarantee for damage to the motorcycle in favour of the Owner
Momoven guarantees the Owner against damage caused to the motorcycle itself by impacts to the external elements of the vehicle, glass breakage, robbery, fire and non-extraordinary natural phenomena during the rental period, with a maximum value per vehicle of EUR 15,000.
The guarantee excludes misappropriation of the vehicle; robbery outside Spain; catastrophic events such as civil or international war, national catastrophe or calamity; extraordinary natural phenomena such as flood, earthquake, volcanic eruption or atypical cyclonic storm; terrorism, riot or popular uprising; actions of the Armed Forces or Security Forces in peacetime; nuclear reaction or radiation and radioactive contamination; driving under the influence of alcohol, drugs or narcotics; driving without the required permit or licence or without the Owner's authorisation; failure to render assistance, regarding the consequences for the authors, accomplices or accessories; participation in races, competitions or training sessions; and driving inside airport premises or on unpaved roads.
In all cases, the repair value may not exceed the market value of the vehicle. In that case, Momoven may replace payment of the repair amount with compensation to the Owner for an amount equivalent to the market value of the motorcycle. Cosmetic damage to luggage accessories such as side cases, saddlebags or top cases will be compensated for an amount not exceeding 50% of their retail price. Damage that renders luggage accessories unusable will be compensated for an amount not exceeding 100% of their retail price or by replacement. Damage to helmets will be compensated for an amount not exceeding 50% of their lowest purchase price.
Momoven reserves the right to recover costs assumed due to damage caused by the Driver in the exclusion cases provided in the section on external motorcycle damage liability and guarantees. Momoven is not an insurance company and is not subject to Spanish Law 20/2015 of 14 July on the organisation, supervision and solvency of insurance and reinsurance entities, or to any other legislation applicable to them.
The rental process is managed through the Platform. Users must provide the requested information, accept the booking conditions, complete the rental agreement, record the condition of the motorcycle at delivery and return, and sign the relevant documents physically or digitally where enabled.
Momoven may tokenize payment methods to process rental payments, deposits, authorised charges, penalties, additional services, incident-related costs and any other amounts owed under these Terms. The User authorises automatic collection when those amounts are due and justified.
Management fees and service fee
The Platform charges management fees and a service fee for the intermediation services provided by Momoven. These fees may apply to booking management, payment processing, changes of dates, incident handling, additional charges, penalties, claim management and any other procedure required to execute or enforce the rental.
If the User requests a change of dates before the agreed delivery date, the change shall be subject to the availability and convenience of the Owner and to the management fees specified on the Platform. Momoven does not guarantee that the change can be made.
The Rider expressly authorises Momoven to store the payment method securely through the payment provider and to use the tokenised payment method to charge the rental amount, the corresponding guarantees, penalties for breach, damage caused to the vehicle, repair, appraisal or management costs, fuel costs, extraordinary cleaning, additional mileage, fines, sanctions or administrative liabilities arising from use during the rental, and any other duly justified cost under these Conditions, before, during or after the rental.
The Rider guarantees that they are the holder of the payment method and that sufficient funds are available. Momoven shall not be liable if the booking cannot be formalised because the charge is rejected for reasons attributable to the Rider.
Cancellation by the Driver
Driver cancellations are subject to the cancellation conditions displayed on the Platform and applicable to the booking. Depending on the time of cancellation and the circumstances, cancellation fees, service fees or non-refundable amounts may apply.
A Driver who has formalised a request may cancel it without penalty provided that the booking has not been completed by paying the rental. Once the rental has been paid, the booking amount is not refundable by default.
The User may change the rental dates before the agreed delivery date by assuming the management fees specified in the management fees and service fee section. The change is subject to the Owner's availability and convenience and Momoven does not guarantee that it will be possible. The User may lose part of the amount paid depending on the time remaining until the start of the rental and whether cancellation insurance has been purchased.
Cancellation and penalty policy
In accordance with Article 103.l) of the consolidated text of the Spanish General Law for the Defence of Consumers and Users, approved by Royal Legislative Decree 1/2007 of 16 November, the right of withdrawal shall not apply to contracts relating to the supply of vehicle rental services.
A motorcycle booking on Momoven is non-refundable by default. The basic cancellation insurance costs ten (10) euros and allows cancellation up to 48 hours before the start of the rental, obtaining a voucher for 50% of the amount paid, redeemable for one year from the rental cancellation date. After that period, no amount will be refunded. Once the refund right is lost, changing the rental date will never restore that right.
The Premium cancellation insurance costs thirty (30) euros and allows cancellation by the Driver up to 48 hours before the start of the rental, obtaining a voucher for 100% of the amount paid, redeemable for one year from the rental cancellation date. After that period, no amount will be refunded. Once the refund right is lost, changing the rental date will never restore that right.
The Owner may cancel the rental by justifying a breach of the requirements established for the Driver. If the Driver considers the Owner's justification incorrect, the Driver may request compensation from Momoven by emailing incidencias@momoven.es and justifying the Owner's error with any documents considered appropriate. This communication must be sent by the Driver within no more than twenty-three (23) hours from the moment of the disagreement. Once that period has elapsed, the Driver accepts that the amounts arising from the cancellation will be paid to the Owner.
Registration requirements, prohibitions, commissions and cancellations for Owners
Owners must provide accurate identification, contact, banking and motorcycle information, hold the rights required to offer the vehicle for rent, keep the motorcycle in suitable roadworthy condition, maintain the legally required insurance and documentation, and make the vehicle available as described in the listing.
In addition to the general requirements established for all Platform Users, Owners must publish photos of the vehicle, its make, model, mileage, engine capacity, country and year of registration and fuel type; be the actual owner of the vehicle or hold sufficient legal title to dispose of and rent the motorcycle; ensure the vehicle is registered in Spain and is less than 20 years old; hold a valid technical inspection; keep any administrative authorisation required for the use of the vehicle in force; provide the mandatory documentation, namely registration certificate, latest insurance receipt and technical sheet; keep the vehicle in good mechanical and maintenance condition; and have roadside assistance included in their usual insurance, providing policy and driver support contact details so that the service can be used during the rental if needed.
Owners must verify the Driver's identity and driving licence before delivery, provide the motorcycle and documentation in proper condition, describe any limitations or relevant circumstances, complete the rental agreement and cooperate with Momoven and insurers when incidents occur.
Owners and Drivers are responsible for correctly and fully completing all sections of the rental agreement provided by Momoven and recording in the observations section all incidents they consider relevant and that may later affect any discrepancy between them. At the meeting with the Driver, the Owner must bring two copies of the rental agreement provided by Momoven for signature and personally verify that the data provided by the Driver during registration is true, especially by checking original documents showing that the Driver holds a valid driving licence in Spain, in force, and is over 23 years old.
Owners must not publish false or misleading listings, rent vehicles that do not meet legal or safety requirements, request off-platform payments, discriminate unlawfully, manipulate reviews, or carry out conduct that damages Users, Momoven or third parties.
Momoven's commissions, payment settlement, cancellation conditions and penalties for Owners are those stated on the Platform or in the applicable commercial conditions. Owner cancellations may generate penalties when they harm the Driver or the service.
During Owner registration, Momoven will request a current account number in the Owner's name to transfer the rent accrued from rental operations completed and cancelled during the previous week. Momoven's intermediation services cost thirty (30) percent of the rental price set by the Owner and of accessories rented through the Platform, excluding applicable taxes. The same thirty (30) percent applies to compensation payable to the Owner for Driver breach regarding agreed mileage and late return of the vehicle.
Where a penalty applies to the Driver under any of the cases provided in this document, the corresponding amount will also be paid to the Owner once collected by Momoven, together with the invoice arising from the service. The Owner expressly authorises Momoven to offset creditor and debtor balances that may arise from penalties contemplated on the Platform or any other expense incurred by Momoven in claiming amounts owed by the Owner, including court fees, lawyers' fees and court representative fees even where their intervention is not mandatory.
The Owner may cancel a rental at any time provided that the rental has not started. The Owner may cancel when the Driver is not fit to drive or lacks the necessary skills, when the identity of the person collecting the motorcycle does not match the person who completed the rental process through the Platform, or when the Driver does not meet Momoven's requirements. Momoven cannot guarantee the truthfulness of User statements through the Platform or mediate cancellations freely decided by Owners and Drivers at meetings before the rental starts, but it may remove profiles whose conduct is clearly contrary to the trust and honesty expected in the Platform community and may retain commissions charged for services and procedures carried out before cancellation.
If the Owner is responsible for cancelling an already confirmed rental, the Owner must assume the penalty established in the cancellation and penalty policy. As an Owner who accepts a booking for their motorcycle, the Owner has an obligation to the Driver to comply with the booking terms. If the Owner is responsible for the cancellation, the Owner will receive a penalty of thirty (30) euros, the Driver will be refunded the full rental amount and Momoven will try to help the Driver find another available vehicle. This penalty will be deducted from the Owner's future earnings. If an event prevents the rental of the booked motorcycle, the Owner must immediately inform Momoven at incidencias@momoven.es, justifying the force majeure reason.
The mileage included in each rental and the cost of additional kilometres are those shown in the booking. Late returns, fuel differences, excessive dirt, missing accessories, damage or any breach recorded at return may generate additional charges.
The motorcycle must be returned at the agreed place and time, in the same general condition, with the agreed fuel level and in a reasonable state of cleanliness. Any delay must be communicated as soon as possible.
If the Driver wishes to extend the vehicle rental period, the extension must be requested through the Platform. The Owner may accept or reject the extension. If rejected, the Driver must return the motorcycle at the place, day and time agreed in the first booking.
If the Driver returns the motorcycle late, the Driver shall pay a penalty that varies according to the delay: EUR 30.00 during the first hour of delay; EUR 10.00 per hour from the first (1) hour up to the first twelve (12) hours; and EUR 20.00 per hour for delays exceeding twelve (12) hours.
Insurance covers twenty-four (24) hour time slots from the time set on the Platform for the start of the rental. Once the time slot in which the rental ends has finished, insurance will no longer apply and any damage shall be the Driver's responsibility, who must bear the expenses caused. At return, the parties must record the incident in the agreement and the Owner must send it to incidencias@momoven.es within a maximum of twenty-four (24) hours after return of the motorcycle.
In Momoven, the Owner sets the maximum daily kilometres the Driver may travel. If the Driver exceeds the kilometre limit defined by the Owner, this must be recorded in the return agreement and the Driver must pay forty cents (EUR 0.40) per extra kilometre travelled plus management fees. This amount will be deducted from the deposit. The Owner must send a copy of the agreement to the incidents email address within a maximum of twenty-four (24) hours.
The Driver undertakes to return the motorcycle with at least the same fuel level stated in the rental agreement at delivery. Failure to do so shall result in a penalty of thirty (30) euros plus management fees, deducted from the deposit. The Owner must send a copy of the agreement and photographic evidence to the incidents email address within twenty-four (24) hours.
The Owner undertakes to deliver the motorcycle in suitable clean condition and the Driver undertakes to return it in a similar condition. A manifestly dirty return shall result in a penalty of twenty (20) euros plus management fees, deducted from the deposit. The Owner must send a copy of the agreement and photographic evidence within twenty-four (24) hours.
Users may rate one another after a rental. Reviews must be truthful, respectful and based on the experience. Momoven may remove content that is false, offensive, unlawful, discriminatory or contrary to the Platform's rules.
Momoven may offer motorcycles from private rental companies and long-term rental services. These services may be subject to specific prices, durations, conditions, documentation requirements, deposits, delivery terms, insurance conditions and cancellation rules shown before contracting.
For rental of a motorcycle from a private vehicle rental company, the User must follow the usual rental process by booking the motorcycle through the Platform and, if the rental is approved, paying for the service through the means established for that purpose. The User may then collect the vehicle at the establishment agreed by the company and the User. At collection, the User must pay the agreed deposit and any other amount arising from accessories the User wishes to purchase, such as helmets or gloves. The Driver and the private rental company shall jointly formalise the vehicle rental agreement.
In these cases, Momoven acts merely as an intermediary and does not provide the insurance offered on the Platform for motorcycle rentals between private individuals. The rental company itself shall offer the User the insurance it considers most appropriate. The same cancellation policy established for motorcycle rentals between private individuals and described in this document shall apply. Requirements for renting motorcycles through private rental companies shall be the same as those set out in this document unless the private rental company and/or its affiliated insurer establish specific or different requirements for the correct execution of the service.
Momoven also offers Users the possibility of contracting motorcycle renting services on the Platform with its own motorcycles or through agreements with private companies. Prices shown on the website for the renting service are indicative and will vary according to the contracted period, kilometres included in the agreement and the vehicle's initial kilometres.
To contract renting for a motorcycle from a private rental company, the User must request a quote for the motorcycle, provide the documents required for the customer risk assessment and, if approved, pay the deposit, authorise charges for damage and penalties, among others, and pay the first service instalment through the means established for that purpose. Each renting contract service is governed by specific conditions for each case and the customer will receive the renting contract once approved.
Momoven is solely a digital meeting place for Drivers and Owners and is not a motorcycle rental agency. Once Driver and Owner accept a rental, they enter into a binding agreement with each other. Momoven is not a party to that contractual relationship and has no direct, indirect or subsidiary liability for damages arising from the rental, without prejudice to the guarantees expressly provided in these Terms.
Momoven may carry out additional checks or procedures to help verify User identities, but Users remain fully responsible for access to and proper use of their profiles and Platform content in accordance with applicable law, good faith, morals, public order and these General Terms.
Momoven provides Users with a standard downloadable rental agreement so Owners and Drivers can understand their rights and obligations before starting a rental. Both parties must accept the agreement conditions through the Platform and may download a copy once the booking has been formalised and paid.
At delivery and return, the parties must check the motorcycle, record mileage, fuel level, documentation, photos, damage and any relevant circumstance. Momoven may make digital signing available through the website with the same validity as the physical agreement.
Photos taken during the signing process will be stored in Momoven's system. Users must also record a detailed video of the motorcycle when appropriate; lack of recording or insufficient visibility may release Momoven from action or liability in a dispute.
If, after the rental has ended, Momoven receives no incident report from the Owner within 24 hours, the rental may be considered completed without incident and without the possibility of later claims.
Users may unsubscribe at any time through the "Delete account" section of their profile or, failing that, by emailing info@momoven.es. Customer service will respond within no more than seventy-two (72) hours.
Content related to the Momoven brand, domains, logos, designs, documentation, software, programs or any protected element belongs to Momoven and all usage rights are expressly reserved. Users may use such material only as expressly authorised by Momoven or by those who have granted Momoven a licence.
Momoven does not assign or transfer any rights over its property or third-party property. Users are not authorised to copy, distribute, transmit, communicate, modify, transform, assign or commercially exploit the property without written consent from the legitimate rights holder.
Content such as photographs and texts uploaded by Users belongs to those Users. Users guarantee that they hold all rights and authorisations needed for that content and that it does not breach any law, contract or third-party right. The User releases Momoven from third-party claims arising from content uploaded to the Platform.

If any clause of these General Terms is void or voidable, it shall be deemed not included. Such declaration shall not invalidate the rest of the agreement, which shall remain valid and effective between the parties.
These Terms are governed by Spanish law. The parties submit, expressly waiving any other jurisdiction, to the Courts and Tribunals of the place where the rental agreement is formalised.
The User may also seek an amicable resolution of incidents through the European Commission online dispute resolution platform: https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=EN.
Momoven reserves the right to modify these General Terms at any time. If changes are made, they will be published on the Platform with the publication date. You will receive electronic notice of the update before publication on the Platform.
Once you receive notice of the modification, you may terminate your agreement before the new Terms enter into force or continue accessing and using the Platform.
